What do I need to do in order to calculate my Personal Assistants Holiday Pay?

You do not need to worry about calculating holiday pay. If we provide a payroll service to you then we will make the necessary calculations for you to ensure that your Personal Assistant receives the correct amount of holiday pay.

How do I explain these changes to my Personal Assistant?

We would suggest that you direct your Personal Assistant to our website where we have outlined how these changes will impact them.  If, however your Personal Assistant has any specific questions then they can contact us and we will be happy to go through the calculations with them.

Will this affect my Budget?

No, these changes should not affect your budget.

How will my PA’s holiday pay be affected?

The changes to the way in which we now have to calculate your Personal Assistant’s holiday pay will actually favour Personal Assistants that work irregular hours or shift patterns.  As a result of these changes we believe that Personal Assistant’s could see an increase in the hourly rate of Holiday Pay they receive.   However, and to be clear, these changes do not mean that your Personal Assistant would be entitled to additional Annual leave –  it simply means that the amount they receive by way of holiday pay may be slightly higher than before.

Do I need to provide you with any additional information?

Yes, you need to provide us with a copy of the contract of employment that you have issued to your Personal Assistant.  This can be supplied to us either by e-mail by sending it to info@disabilityfocus.org or alternatively you can post a copy to us at Disability Focus, Follaton House, Plymouth Road, Totnes, TQ9 5NE.

If I have not issued a contract of employment what do I need to do?

You will need to ensure that you issue one without delay.  Failing to provide your employed Personal Assistant with a contract of employment is a breach of Employment Law.  Even if you employ a family member or a friend they still need to have a contract of employment issued to them.

What if I don’t have Employers Liability Insurance?

If you do not have Employers Liability Insurance in place then in the event of an incident you may be held personally liable. There are a number of organisations that specialise in providing this type of insurance.
