A Deputy is appointed by the Court of Protection. A capacity assessment around financial management is completed by either a social worker or medical professional to accompany an application to the Court.
Disability Focus, as a not-for-profit organisation, will charge fees that the Court permit a Deputy to charge at the same rate as a Local Authority acting as Deputy.
Referrals would normally be made by a social worker or other professionals who believes that an individual would benefit from this service. A Deputy follows the Mental Capacity Act 2005 principles and reports to the Office of the Public Guardian.
A person who has been assessed as lacking capacity to manage their own property and financial affairs.
A Court of Protection Appointed Deputy is someone who makes financial decisions on behalf of the incapacitated person.
The Deputy will manage the financial affairs of the incapacitated person and abide by the court order. The Deputy will follow the principles of the Mental Capacity Act 2005 and be supervised by the Office of the Public Guardian.

A corporate appointee is an organisation approved by DWP, that manages the benefits and bills on behalf of a client who may not be able to manage their own finances. A deputy will have these responsibilities too as well as the duties and powers of a deputyship.
The Court of Protection instructs a deputy to act in all financial matters and is fully responsible for the management of the customer’s financial affairs. Any responsibility undertaken as an Appointee will also be undertaken as a Deputy.
